Today, the Court of Appeal in Warsaw dismissed Santander Bank’s appeal in a case to declare a loan agreement invalid. As a result, the first-instance court’s judgement, which was favourable to the debtors, has become legally binding. As a result of the ruling, they will recover all the interest paid and consequently bear no credit costs, which, according to the position of the European judiciary, is supposed to play a preventive role for banks, preventing their eventual, subsequent unfair practices.
In this case, the lawsuit was filed after the loan had been repaid in full and after the debtor’s divorce.
