Polish parliament is currently working on two bills aimed at facilitating the protection of personal rights against authors who violate them by posting false or defamatory comments on the Internet, in particular on social media. Under current regulations, a lawsuit must precisely identify the authors of such a post, including their place of residence, which is very difficult in practice as these individuals often publish under pseudonyms. The draft bills propose that the injured party will not have to provide this information, which will instead be determined by the court.
Our law firm, on behalf of the Supreme Bar Council, prepared an opinion on one of the above-mentioned drafts, and on 11 June 2025, at a meeting of the Standing Subcommittee on Civil Law Reform, attorney Maciej Obrębski presented detailed comments on the proposed provisions.
