Advocate Maciej Obrębski comments in Dziennik Gazeta Prawna on a draft major amendment to the Polish Code of Civil Procedure, which has been entered into the Council of Ministers’ list of legislative and programme work. The proposals, prepared by the Civil Law Codification Commission, include, among other things, extending the time limit for filing an appeal to one month, abandoning so-called “horizontal interlocutory appeals,” and (in certain cases) restoring three-judge panels in appellate proceedings.
As Mr Obrębski emphasises, in cases of the greatest significance, what matters is collegial appellate review and substantive discussion within the adjudicating panel:
“Collegiality before the courts of appeal must be restored (…) in conditions that allow for a substantive discussion within the adjudicating panel.”
