Cooperative Law

At present, the cooperative movement is not significantly developed in Polish agriculture. One of the reasons for this is undoubtedly the forced introduction of collective farming during the communist period. The experience of Western Europe, on the other hand, is quite different and it is worth drawing on these models.
Cooperatives function very well e.g. in France, the Netherlands, Denmark or Germany, where farmers sell at least 60% of their production through cooperatives, and in the case of some products (such as milk, pork or wine), this share reaches 80-100%. In western countries, the process of cooperatives taking over important enterprises (limited companies) in the agri-food sector is no longer surprising. Consequently, there is no shortage of examples of cooperatives with an annual turnover in excess of €1 billion, and even some that are among the world’s leading agricultural producers. For cooperatives can be a flexible and modern form of business, not only in agriculture and not only in Western Europe. It is worth considering this model when planning to start a business in Poland and benefit from our experience. Among other things, we have handled cases of acquisitions of agricultural cooperatives with their assets. We have represented cooperatives in the process of selling their assets as well as cooperative members in numerous court proceedings for the annulment or revocation of resolutions of general meetings. We have also confirmed in court the membership in a cooperative of many persons which, in the opinion of the cooperative, has ceased.
