We specialise in film and television production matters, providing legal assistance at every stage of film development and exploitation, from obtaining rights to literary material and arranging cooperation with co-producers, investors, creators and performers, through the production stage (where we react dynamically to conceptual changes of creators and unexpected situations on the set) and post-production, to legal protection of the effectiveness of the distribution stage in various fields of exploitation.

We take a holistic view of the film development and exploitation process, not only through our experience in providing legal assistance to the film community, but also through our industry education and experience in film production. As a result, we understand how extensive the producer’s responsibility is and how much risk is involved in the entire production. That is why we propose solutions and safeguards to be implemented at the earliest possible stage of production to ensure its safety and contribute to its financial return. Films on which we have provided legal assistance have so far been distributed on three continents.

We specialise, among others, in:

  • advising on the choice of an appropriate form of business for film production,
  • acquisition of rights to literary and archival material and music rights,
  • analysing the content of literary material for infringements of third-party rights and personal rights,
  • clearing rights for film production (Clearing Rights, Chain of Title),
  • providing assistance in obtaining public funding for film production (e.g. from the Polish Film Institute and regional film funds),
  • drawing up a revenue-sharing plan (recoupment plan) for film productions,
  • drafting, reviewing and negotiating contracts, inter alia with co-producers, investors, creators, performers, artistic supervisors, technical crew, distributors, sales agents,
  • drafting and negotiating contracts to secure the interests of film-makers (e.g. script-writers, directors, cinematographers, composers, production designers, editors) and performing artists (e.g. actors, musicians and singers),
  • assessing the risks involved in the realisation of a film production,
  • controlling the execution of the film production in accordance with the provisions of the contracts,
  • representing the film community in court disputes.
