Inheritance law has something of the defusing of a bomb – one mistake and we irreversibly say goodbye to the inheritance mass. This is particularly true in the case of succession proceedings which have elements of foreign law in them, when, for example, a testament has been drawn up abroad, in a different language and the court has to decide on the question of proper jurisdiction.
We have repeatedly encountered the issue of foreign jurisdiction when regulating the inheritance cases of landed families, which war and communist repression (including the nationalisation of estates) had often thrown even across the ocean. We have dealt with the tracing of ancestry and the search for heirs, conducting international searches and establishing the facts of the families’ lives, which in several cases have also made it possible to discover completely unexpected information about their members.
