Post-COVID Syndrome Among Entrepreneurs

The so-called “post-COVID syndrome” refers to a range of diverse symptoms that persist for more than 12 weeks after a COVID-19 infection. It turns out that the long-term consequences of infection with this virus are difficult to manage—it is impossible to predict in which patients they will occur, how long they will last, or whether they can be eliminated permanently.

As it happens, “post-COVID syndrome” is not solely a medical concept—it also exists in the legal sphere. It is worth recalling that although the COVID-19 virus itself was a threat, its burden was amplified by compulsory isolation, the forced suspension of business activity by entrepreneurs, and a series of more or less sensible bans and orders, the breach of which was, of course, linked to severe sanctions.

The consequences of such regulations—often adopted overnight and at the same time poorly drafted, mutually contradictory, and unclear—continue to weigh on Polish companies. Entrepreneurs are still struggling with penalties imposed for alleged breaches of COVID regulations, as well as with ambiguous provisions that, during the pandemic, modified obligations towards various institutions, the calculation of time limits, and the resulting allegations of failure to comply with statutory duties.

At least in this latter respect, however, there is an effective remedy: competent legal assistance leading to the final revocation of imposed sanctions. This is exactly the outcome our Law Firm achieved this week in a case handled by advocate Maciej Obrębski and attorney-at-law Roman Radosław Gospodarczyk. The repeated annulment of the decision imposing a financial penalty, followed by the issuance of a decision discontinuing the administrative proceedings, ultimately brings to an end the Client’s years-long struggle with the sanctions of the pandemic period.
