The Civil Law Codification Commission plans to introduce compensation and damages tables based on data from recent years in order to speed up payments and reduce the number of court disputes.
Attorney Maciej Obrębski points out that the tables may facilitate the standardisation of practice, but should not be binding on the courts. The injured party should retain the choice between judicial and extrajudicial proceedings, e.g. through special commissions similar to provincial commissions for adjudicating medical incidents, with the right of appeal to the court. He also proposes indexing the amounts (e.g. to inflation or salaries) and a tariff for typical events instead of complex algorithms.
