In a case conducted by advocate Maciej Obrębski and attorney-at-law Artur Pietruszka, the Regional Court in Rzeszów awarded over PLN 2.5 million in compensation plus interest to a client of the Law Firm. The case concerned a palace and park complex, which had been taken over by the State Treasury in 1944 on the basis of the provisions of the decree of 6 September 1944 on the implementation of agricultural reform. Subsequently, in the 1990s, the property was transferred by a decision of the Rzeszów Voivode to the county, which in turn donated it to another public entity.
In many years of proceedings before public administration bodies and administrative courts, it was possible to prove the unlawfulness of the takeover of the property for the purposes of the agrarian reform and, subsequently, the gross violation of the law in issuing the decision of the Rzeszów Voivode. The donation made by the county made it impossible to recover the property in kind, which is why the Law Firm’s client decided to claim compensation.
The court case against the State Treasury was particularly complicated due to the objections raised on the grounds of entanglement and statute of limitations, as well as the need to use an expert property expert’s opinion.
However, in the verbal justification of the judgment, the Court emphasised that the arguments presented by the Law Firm were accurate and that our client was entitled to high compensation.
