The Regional Court in Poznań, in accordance with the request of the heirs, represented by advocate Maciej Obrebski, established that their ancestor on the date of communalization, i.e. the date of the State Treasury’s transfer of ownership to the municipality, was the owner of the properties comprising the Czerwona Wieś land estate.
This case was one of the stages of efforts to obtain compensation for the roads included in the estate in the face of the impossibility of recovering them in kind. The need to file the aforementioned lawsuit arose as a result of a change in the view of the Minister of Internal Affairs and Administration, which for several years has required the submission of a court decision in this regard along with a request to declare that the communalization decision was issued in flagrant violation of the law.
